Song Of The Day Official Rules

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. A PURCHASE OR PAYMENT WILL NOT INCREASE YOUR CHANCE OF WINNING.

1. HOW TO ENTER

a. These rules govern CBS-FM’s Bahamas Escape promotion (the “Promotion”) being conducted by WCBS-FM (the “Station”), beginning on Monday, May 13, 2013 at 7:00AM Eastern Time (“ET”) and ending on Wednesday, May 22, 2013 at 8:00PM ET (the “Promotion Period”).

b. To participate in the Promotion, you may enter by phone or online:

ON-AIR: Listen to the Dan Taylor Show, weekday mornings beginning on Monday, May 13, 2013 and ending on Wednesday, May 22, 2013 between the hours of 7:00AM ET to 9:00AM ET for Dan Taylor to announce the Song of the Day (the “Song”). Then, listen to the Station throughout the day for the Song to air. When you hear the Song played in its entirety, be the 101st caller to the Station contest line at 1-800-367-1101 to correctly name the Song and win a trip for two to the Bahamas, pending confirmation of eligibility. At the time of their call, callers will be required to provide all information requested including their full name, complete address (including zip code), day and evening phone numbers and date of birth in order to be eligible to win. In the event that the selected caller is disconnected or is found to be ineligible, no alternate winner will be chosen. There is no limit to the number of times a listener may attempt to call in to win, but a listener may be a prize winner only once. There will be up to a total of eight (8) prize winners selected on-air during the Promotion Period, one (1) prize winner per day. The Station is not responsible for telephone service outages, delays, busy signals, equipment malfunctions and any other technological difficulties that may prevent an individual from completing his/her telephone call. Due to delays in the Station’s online streaming of its broadcast signal, listeners to the online stream may not be able to participate in or may be disadvantaged in participating in on-air contests.

ONLINE: You may log onto http://www.wcbsfm.com contest page during the Promotion Period and follow the links and instructions to enter the Promotion and submit your first name and last name, complete address, city, state, zip code, telephone number, date of birth, a valid email address in the online entry form. Online entrants are subject to all notices posted online including but not limited to the Station’s Privacy Policy. Limit one (1) entry per eligible person per day during the Entry Period regardless if entrant has more than one email address. Multiple participants are not permitted to share the same email address. P.O. Boxes are not permitted. Entries submitted may not be acknowledged or returned. Proof of submission of an entry shall not be deemed proof of receipt by the Promotion administrator. All entries must be received by 11:59PM ET on Tuesday, May 28, 2013. Any entry received after this time will be considered ineligible. On Wednesday, May 29, 2013 at approximately 10:00 AM ET, one (1) prize winner will be randomly selected from among all eligible online entries received.

2. ELIGIBILITY RESTRICTIONS

a. The Promotion is open to all persons who are 21 years of age or older and who reside in the tri-state area of New York, New Jersey and Connecticut. Employees of the Station, its licensee, the licensee’s parent, Promotion’s Sponsor(s), subsidiary and affiliated entities, Station’s advertising and promotional agencies, its participating sponsors, other radio stations in the New York metropolitan area, the members of their immediate families (spouse, parent, sibling or child) and those living in the same household of each (whether related or not), are ineligible to enter or win. This Promotion is subject to all applicable federal, state and local laws and regulations and is void where prohibited.

b. Only one (1) winner per household is permitted in any Station promotion. A person may not win a Station promotion if a member of his/her family or household has won a Station promotion within thirty (30) days and a prize valued at $600 or more only once every six (6) months.

c. Each winner must provide valid government-issued photo identification and provide their complete address, date of birth and phone number to claim a prize.

d. Entrants are required to provide truthful information and the Station will reject and delete any entry that it discovers to be false or fraudulent. The Station will disqualify any entry from individuals who do not meet the eligibility requirements.

3. PRIZE
a. A maximum of eight (8) prizes will be awarded during the Promotion. Each prize is one (1) four (4)-day/three(3)-night Sandals Resorts Luxury Included® Vacation for two (2) adults (Winner and one (1) guest, 21 or older) to Sandals Emerald Bay Great Exuma, Bahamas.
Trip includes:
(i) Round trip coach airfare for two (2) provided by Unique Vacations, Ltd. on American Airlines. Airfare is valid to/from the nearest major gateway to the resort designated airport. American Airlines will serve as the official airline sponsor. Each passenger will be responsible for applicable travel taxes. Restrictions may apply.

(ii) Double occupancy (single room) deluxe hotel accommodations.
The prize will include Luxury Included® deluxe accommodations, all meals, including gourmet dining, unlimited premium brand beverages, daily and nightly entertainment, all land and water sports, including scuba diving (for certified divers), snorkeling, gratuities, and transfers to and from the Resort designated airport.

(iii) Telephone calls, Internet, Red Lane® Spa treatments and services,
specialty dining, tours & excursions, inter-island transportation, SCUBA certification courses, island departure taxes and purchases made at the Beaches Specialty Shops are not included.

(iv) Prize must be redeemed for travel by May 25, 2014 and is subject to availability and black-out periods, and is not transferable or redeemable for cash. No extension will be given after the prize has expired. Tickets are subject to availability and black-out periods, when travel is prohibited (black-out dates to be determined). Restrictions and blackout dates may apply.

(v) A processing fee of $25.00 per room, per night double occupancy will apply to each prize. The $25.00 USD is a processing and administrative fee to help offset gratuities collected but not limited to housekeeping, airport transfers, all dining a-la-carte services, concierge service, etc. Payment by either credit card or check is to be made upon receiving hotel confirmation, or the reservation will be canceled.

(vi) Reservations and confirmation of travel dates will only be provided thirty (30) days prior to the departure date.

(vii) Sandals Resorts reserves the right to relocate any confirmed prize winner from their resort of choice to an alternate resort within our chain based upon availability of space for the secured travel dates.

Approximate Retail Value (“ARV”) of each prize is $3,500

b. Actual ARV may vary depending upon airfare in effect at time of travel. Travel must be booked a minimum of ninety (90) days in advance of travel. Travel companion of the prize winner must be 21 years of age or older. Winner and travel companion are solely responsible for obtaining travel insurance (and all forms of insurance) where applicable, at their option, and hereby acknowledge that the Station has not and will not obtain or provide travel insurance or any other form of insurance. Any winner of certificates/vouchers will be subject to the terms and conditions as set forth by the provider of the certificate/voucher. Any certificates/vouchers are not refundable or transferable, and may not be substituted or exchanged for cash or credit at any time. Lost or stolen certificates/vouchers will not be replaced. Prize winner and travel companion are solely responsible for all applicable taxes including but not limited to hotel and hospitality taxes, telephone charges, meals, gratuities, ground transportation at point of origin and any other expenses not specifically offered herein. Prize winner may be required to present a valid credit card upon hotel check-in to cover incidental expenses incurred during stay.

c. Certain travel restrictions may apply. Travel arrangements must be made through Unique Vacations, Ltd. Prize is subject to availability. If the winner cannot travel on dates specified by the Station, the winner may be disqualified and an alternate winner may be selected (time permitting) in the Station’s sole discretion. The winner and travel companion(s) must travel on the same itinerary and are responsible for obtaining all required travel documents, including, without limitation, passports for international travel. Airline regulations apply. The winner and travel companion(s) must sign a Publicity, Liability Waiver and Travel Release form prior to traveling. If a prize-related event is unable to take place as scheduled, for reasons such as cancellation, preemption, postponement or unavailability, including for weather, or for any reason beyond the control of the Station, the Station’s sole responsibility to the winner will be to award the remaining available portion of the prize and no substitution or compensation will be provided for the unawarded portion of the prize.

d. All prizes or prize certificates may be picked up during regular business hours at the office of the Station at the address below. Each winner will forfeit any prize or prize certificate not claimed within ten (10) days of winning. In the event that a prize or prize certificate is mailed to the winner, it will be with the prior written consent of the winner and therefore, winner assumes the risk of its loss. The Station is not responsible for the safe arrival of a prize or prize certificate.

e. There is no substitution, transfer, or cash equivalent for prizes, except that Station may, at its sole discretion, substitute prizes of comparable value or cash. The prizes are expressly limited to the item(s) listed above and do not include taxes, gratuities or any other expenses. Other restrictions may apply.

4. WINNER SELECTION AND NOTIFICATION

a. Decisions of Station management with respect to the Promotion are final.

b. Up to eight (8) Prize winners (up to one (1) prize winner per weekday) will be selected on-air as described in Section 1 of these Official Rules. The Station will notify each on-air winner by phone at the time of their call and prize will be awarded upon confirmation of eligibility.

c. On Wednesday, May 29, 2013 at approximately 10:00 AM ET, the Station will select one (1) potential Prize winner through a random drawing from all eligible online entries received during the Promotion Period. The Station will notify the potential Prize winner by phone following the Prize winner drawing. The Prize will be awarded upon confirmation of eligibility.

d. Odds of winning on-air depend in part on the number and order of calls received and correctly naming the Song of the Day. Odds of winning through online entry depend upon the number of eligible online entries received during the Promotion Period.

e. On-air winners need to listen to Station to win on-air to correctly name the Song of the Day but do not need to be present to win. Online entrants need not listen to Station nor be present to win.

f. Each winner must execute and return any required affidavit of eligibility and/or liability/publicity release within ten (10) days of winning or prize will be forfeited. If a potential winner cannot be contacted, fails to sign and return the required affidavit of eligibility and/or liability/publicity release within the required time period, or if a prize or prize notification is returned as undeliverable, the potential winner forfeits the prize.

5. CONDITIONS

a. Payments of all federal, state and local taxes are solely the responsibility of the winner. The winner will be required to complete and submit an IRS Form W-9 with the winner’s full Social Security Number or the equivalent for receipt of any prize valued at $600 or more or for any prizes awarded by the Station (or any other CBS Radio station in Station’s market) in a calendar year with an aggregate value of $600 or more. Failure to submit a complete W-9 or equivalent will result in forfeiture of the prize. Such winnings of $600 or more will be reported to the IRS.

b. By participating in the Promotion, the winner agrees to have the winner’s name, voice and likeness used in any advertising or broadcasting material relating to the Promotion without additional financial or other compensation, and, where legal, to sign a publicity release confirming such consent prior to acceptance of the prize.

c. Prior to awarding any prize or prize certificate, the Station, in its sole discretion, may require Promotion winner (and any travel companion(s) or guest(s)) to sign a liability release, agreeing to release and hold harmless the Station, its licensee, the licensee’s parent, subsidiary and affiliated entities, their respective officers, shareholders, directors, employees, agents and representatives and all of their successors and assigns from and against any and all claims or liability arising directly or indirectly from the prize and participation in the Promotion.

d. If for any reason this Promotion cannot be executed as planned, including, but not limited to, as a result of infection by computer virus, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Station that corrupt or affect the security, administration, fairness, integrity or proper conduct of the Promotion, or if the Promotion is compromised or becomes technically corrupted in any way, electronically or otherwise, the Station reserves the right to cancel, terminate or modify the Promotion. If the Promotion is terminated before the original end date, the Station reserves the right to select the winners by random drawing from among all eligible non-suspect entries received as of the termination time/date or otherwise modify the procedure for selecting winners.

e. The Station, in its sole discretion, reserves the right to disqualify any person tampering with the entry process or the operation of the Station’s website. Failure to comply with the rules of the Promotion may result in a contestant’s disqualification and/or forfeiture of any prize or prizes. If the Station makes a good faith determination that an entrant has cheated or committed fraudulent activity in connection with a Promotion, the Station reserves the right to disqualify that entrant from entering and/or winning future Promotions and to prosecute and seek damages to the fullest extent permitted by law.

f. The Station reserves the right to make changes in the rules of the Promotion, including, without limitation, the substitution of a prize of equivalent value, which will become effective upon announcement. If due to circumstances beyond the control of the Station, any competition or prize-related event or travel is delayed, rescheduled, postponed or cancelled, the Station reserves the right, but not the obligation, to cancel or modify the Promotion and shall not be required to award a substitute prize.

g. The Station is not responsible for typographical or other errors in the printing, the offering or the administration of the Promotion or in the announcement of a prize.

h. For a copy of these Official Rules, send a self-addressed stamped envelope for receipt by May 27, 2013 to “CBS-FM’s Bahamas Escape – Official Rules,” Attn: Promotions, WCBS-FM, 345 Hudson Street, 10th Floor, New York, NY 10014. For the names of the prize winners send a self-addressed stamped envelope for receipt by July 27, 2013 to the above address marked “CBS-FM’s Bahamas Escape – Winner List.” The Official Rules and the Winner List (when completed) shall also be available during regular business hours at the main offices of the Station and may be posted online at http://www.wcbsfm.com
